Enforcement for FDA FSVP in 2019
Full FDA FSVP Enforcement Action will begin Fiscal Year 2019
The Foreign Supplier Verification Program, implemented May 30, 2017, “requires importers to verify that their foreign suppliers of food for human and animal consumption meet applicable FDA safety standards. More specifically, FSVP requires that importers verify that their suppliers are producing food using processes and procedures that offer the same level of public health protection as the preventive controls (PC) requirements in the preventive controls and current good manufacturing practices rules for human food and animal food and produce safety FSMA rules, and that the food is not adulterated and properly labeled with respect to allergens.” [FDA.gov]
“Food importers that aren’t complying with Foreign Supplier Verification Program requirements should expect enforcement action from the Food and Drug Administration to begin over the next year,” said Dominic Veneziano of Veneziano Consulting, at the Food and Drug Law Institute’s Enforcement Litigation and Compliance Conference on Dec. 12.
Some of the actions FDA will take are warning letters and import alerts if importers don’t have an FSVP in place. If importers do have something in place, make sure to communicate with your logistics provider. That information must be transmitted at time of entry.
